License Extension Request / Closure Pending Investigation

If the reason for your extension request is not listed please contact the appropriate Triage. Please note that extensions should not be used to resolve issues pertaining to the licensor or the licensing agency.

Explanations

1. License under temporary immediate suspension

  • If a license is set to expire while under a temporary immediate suspension, an extension can be requested to allow time for the investigation to conclude. The program CANNOT operate during this time.

2. License under appeal of indefinite suspension

  • If a license is set to expire while under appeal of an indefinite suspension, an extension can be requested to allow time for the appeal process to conclude.

3. Current investigation

  • Program under investigation: If a license is set to expire while there is an ongoing child/adult protection and/or licensing investigation, an extension can be requested to allow time for the investigation to conclude. The program can operate during this time if the licensing agency determines that persons served are not at immediate risk of harm.
  • Pending licensing action: If a license is set to expire while the licensing agency is working on or has already submitted a licensing action recommendation to DHS, an extension can be requested to allow time for the licensing action order to be issued.

4. Operating pending completion of relicensing

  • License holder moving within 1 month of license expiration: If a license holder plans to change premise within 1 month of their license expiration, an extension can be requested. Relicensing at the new premise must be completed within 1 month. If it will be longer than 1 month, relicensing must occur at the current premise; an extension should NOT be requested in this case.
  • Finalization/transfer of custody hearing scheduled (1-month extension): If a license is set to expire within 1 month of finalization/transfer of custody, an extension can be requested ONLY if all of the following conditions are met: (a) the hearing must be scheduled and the date written on the extension request form; (b) the license holder closes their license following the finalization/transfer of custody; and (c) the license holder and licensor both understand that if the hearing is delayed beyond the extension expiration, relicensing must be completed. A second extension should NOT be requested in this case.
  • If the reason for your extension request is not listed, you need to contact us to consult. For example, license holder did not respond to relicensing materials, illness in the family, etc. Be prepared to give a detailed explanation of the situation and why you think an extension is warranted. Please use ELMS to monitor your caseload. (If you are aware of variances that are either missing from the report or should not be listed on the report, please contact us.) With up to 120 days advance notice, there should be very few situations that actually warrant a license extension.

5. Closure requested during investigation

  • If the license holder requests to close their license during an investigation or when there are unresolved issues (e.g. a licensing action recommendation has been made, a background study violation has been identified, etc.), complete this form to close the license “pending investigation”. This will indicate that the license is closed, but that there are unresolved issues. Requesting license closure does not preclude license holders from sanctions. Enter the effective date that the license should be closed; this should be the date that you received written notification from the license holder that they want to close their license. Do NOT submit a 3324 to close the license at this time.
